Terms of Service

By accessing or using Earningbirds (the “Service”), operated by EarningBirds Inc. (“we”, “us”), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

You must be at least 13 years old (or the minimum age in your jurisdiction) to use the Service. If you use it on behalf of an organization, you represent that you are authorized to accept these Terms for it.

You are responsible for your account, for keeping your credentials secure, and for all activity under your account.

You retain ownership of the prompts, uploads, and videos you create with the Service (“Your Content”), subject to the rights of any third-party model providers as disclosed.

You grant us a limited, worldwide license to host, process, and display Your Content solely to operate and provide the Service to you.

You represent that you have the necessary rights to your uploads and that Your Content does not infringe the rights of others.

Some videos may include real archival photographs sourced from public archives, limited to scenes depicting documented historical events, people, or places. We use only material that carries no attribution requirement (public domain, CC0, and equivalents). We do not own the copyright in such material, so the ownership stated in the first paragraph of this section does not extend to it. We provide the source and license information for any material used. Public domain status is determined differently from country to country, and confirming it for your territory remains your responsibility.

You agree not to use the Service to create or distribute content that is unlawful, infringing, defamatory, hateful, harassing, or that is sexually explicit, pornographic, or exploits or endangers minors.

You will not generate realistic depictions of identifiable real people without their consent (except for historical figures who died at least 50 years ago, treated in an educational or documentary context), impersonate others, create deceptive “deepfakes”, produce non-consensual likenesses or voice imitations, or produce content intended to defraud or mislead.

You will not use the Service in connection with any activity prohibited by our payment provider, including but not limited to fraud, intellectual-property infringement or illicit streaming, gambling, adult or dating services, regulated financial or money-transfer services, sale of controlled or illegal goods, or content that promotes violence or physical harm.

You will not attempt to reverse engineer, disrupt, overload, or bypass the technical limits or security of the Service, nor resell or redistribute the Service without our written permission.

Videos are produced by automated AI systems. Output may be inaccurate, unexpected, or similar to content produced for other users, and is provided without warranty of fitness for any particular purpose.

You are responsible for reviewing generated content before publishing or relying on it, and for ensuring your use complies with applicable laws and platform policies.

The archival scenes described above are genuine records rather than AI-generated imagery. Please label AI-synthesized content on YouTube and other platforms based on the elements your video actually contains.

To keep the Service compliant with these Terms and with the acceptable-use policies of our payment provider, every generation request is automatically reviewed before processing. Requests that depict identifiable real people, ask to imitate a specific person’s voice, or otherwise fall into prohibited categories are declined before any content is generated, and the attempt is logged. An exception applies to historical figures who died at least 50 years ago when treated in an educational or documentary context; such scenes use public-domain archival photographs where available. No exception applies to living or recently deceased individuals.

The Service does not offer face-swap or voice-cloning features. Narration voices are selected only from a fixed library of commercially licensed preset voices, and generation is driven by text prompts. Reference images you upload may only contain material you have the rights to and may not be used to reproduce a real person’s likeness.

We may review flagged or blocked activity, and repeated or deliberate attempts to violate these policies may result in suspension or termination of your account as described in the Termination section.

Paid plans are billed in advance on a recurring basis until cancelled. Payments are handled securely by our third-party payment provider, and we do not store your full card details. You can cancel at any time; access continues until the end of the current billing period.

Credits and plan limits reset according to your plan and do not roll over unless stated otherwise.

Refunds and cancellations are governed by our Refund Policy and by any mandatory consumer rights in your jurisdiction. Except as set out there or as required by law, fees are non-refundable.

The Service, including its software, design, and branding, is owned by EarningBirds Inc. and protected by intellectual property laws. These Terms do not grant you any rights in our trademarks or technology beyond use of the Service.

You may stop using the Service at any time. We may suspend or terminate your access if you violate these Terms or use the Service in a way that risks harm to others or to Earningbirds.

The Service is provided “as is” and “as available” without warranties of any kind, to the maximum extent permitted by law.

To the fullest extent permitted by law, Earningbirds will not be liable for indirect, incidental, or consequential damages, and our total liability will not exceed the amounts you paid us in the twelve months before the claim.

These Terms are governed by the laws applicable at our principal place of business, without regard to conflict-of-law principles. Disputes will be resolved in the courts of that jurisdiction, unless otherwise required by law.

We may update these Terms from time to time. If we make material changes, we will notify you through the Service or by email. Continued use after changes take effect constitutes acceptance.
