Terms of Service

By accessing or using Earningbirds (the “Service”), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

You must be at least 13 years old (or the minimum age in your jurisdiction) to use the Service. If you use it on behalf of an organization, you represent that you are authorized to accept these Terms for it.

You are responsible for your account, for keeping your credentials secure, and for all activity under your account.

You retain ownership of the prompts, uploads, and videos you create with the Service (“Your Content”), subject to the rights of any third-party model providers as disclosed.

You grant us a limited, worldwide license to host, process, and display Your Content solely to operate and provide the Service to you.

You represent that you have the necessary rights to your uploads and that Your Content does not infringe the rights of others.

You agree not to use the Service to create or distribute content that is unlawful, infringing, defamatory, hateful, or sexually exploitative.

You will not generate realistic depictions of identifiable real people without their consent, impersonate others, create deceptive “deepfakes”, or produce content intended to defraud or mislead.

You will not attempt to reverse engineer, disrupt, overload, or bypass the technical limits or security of the Service.

Videos are produced by automated AI systems. Output may be inaccurate, unexpected, or similar to content produced for other users, and is provided without warranty of fitness for any particular purpose.

You are responsible for reviewing generated content before publishing or relying on it, and for ensuring your use complies with applicable laws and platform policies.

Paid plans are billed in advance on a recurring basis until cancelled. You can cancel at any time; access continues until the end of the current billing period.

Fees are non-refundable except where required by law. Credits and plan limits reset according to your plan and do not roll over unless stated otherwise.

The Service, including its software, design, and branding, is owned by Earningbirds and protected by intellectual property laws. These Terms do not grant you any rights in our trademarks or technology beyond use of the Service.

You may stop using the Service at any time. We may suspend or terminate your access if you violate these Terms or use the Service in a way that risks harm to others or to Earningbirds.

The Service is provided “as is” and “as available” without warranties of any kind, to the maximum extent permitted by law.

To the fullest extent permitted by law, Earningbirds will not be liable for indirect, incidental, or consequential damages, and our total liability will not exceed the amounts you paid us in the twelve months before the claim.

These Terms are governed by the laws applicable at our principal place of business, without regard to conflict-of-law principles. Disputes will be resolved in the courts of that jurisdiction, unless otherwise required by law.

We may update these Terms from time to time. If we make material changes, we will notify you through the Service or by email. Continued use after changes take effect constitutes acceptance.
